D.A. seeks death penalty for killer

Prosecutors want the death penalty for a Stanton man convicted Wednesday of one murder and multiple rapes, including one in Costa Mesa.

DNA and forensic evidence linked Waymon Livingston, 29, to the crimes, the Orange County district attorney’s office said.

Livingston was found guilty of one felony count of special-circumstances murder in the commission of sodomy, three felony counts of forcible rape, and one felony count of aggravated assault, according to a D.A. news release.

Prosecutors contended in the jury trial that among Livingston’s victims was a private masseuse who was raped and strangled in a Costa Mesa motel room in May 2007, a few months before Livingston’s eventual arrest at his Stanton home by Anaheim police that October.

Livingston’s murder victim was a 21-year-old prostitute from Sacramento who was killed in September 2007 in an Anaheim motel room, prosecutors said.

Livingston had at least six victims total, some of whom were prostitutes, the D.A.’s office said.

The penalty phase of the trial is scheduled to begin March 6 at the Central Justice Center in Santa Ana.
